While it’s true they don’t handle civil matters, even if the paperwork says it’s to be enforced by police like in my case, the paperwork also states any violation is punishable for jail terms and contempt of court. I’m sure dad is aware that he doesn’t have to bring her back as police won’t make him BUT, if you get a cop that cares, he will do it. I’ve had them do it for me after I reported my child missing. The operator asked for his identifying information and notified authorities. I told them his father never brought him back and I didn’t know where they were. Hadn’t let me see him. I didn’t know if he was okay. This was a week after. And my son is a baby. That’s a no-no. And you are correct about the emergency custody option. The police will be able to enforce that one if the other fails. A warrant will be issued for his arrest in this case. He can be charged with parental kidnapping. What he is committing is custodial interference. It’s a crime. She can report it to police and they investigate. Now if she knows where they are, I would not care what that man says.
