  11. Your son has to charged with a crime for him to violate his probation. Also, the P.O. has no power to arrest, they only make suggestions to the judge (who has the power to order arrest). You need to decide if that’s what you want.

  12. Don’t know about MN (TX here), but talk to your officer. If your eligible than it shouldn’t be a problem. I for one love helping people get off probation. A lawyer makes things easier, they do all the leg work; you just have to deduce if the fee you would pay the lawyer to expedite the process would be worth it.   14. Where I am, yes, you have to have a negative hair follicle. However, every department has different policies in that regard. To get off early where I am you have to have all your fees and restitution paid, no recent failed UA’s, a negative hair follicle, and if on for any assaults or violence the victim has to okay the early termination.

  15. Don’t expect anything for the 1st fail: take a drug evaluation and maybe some classes. Fail 2: expect more classes $$$ and probably put on more frequent UA’s $$$. Fail 3: This is when it get serious, expect an admin hearing and maybe talk about drug court. Fail 4: expect talk about revocation, even possible revocation. More fails: your fucked.

All of the early releases I have ever done have had to do hair tests before the probation department supervisors will sign the letter they send to the judge with their recommendation for early release. That and you have to be current on all your fees and paid all your restitution, and if it’s an assault charge the victim has to okay it.

  21. No, just tell them you had a scheduling mix up and need to come in one day early. They either have the time available or not. PO’s are more concerned when you ask to come later than before.

  22. Sobriety is hard for those who aren’t used to it and who’s social lives revolve around it. I have immense respect for those that can see rock bottom and claw themselves back up from whatever level their on. Probation is sooo hard for those people who’s identity is tied to a substance and I hope they see that there is going to be plenty of time to drink, smoke, or do whatever they want when it’s done; just not when Johnny law is breathing down their neck. The alternative is having sobriety forced on you and when that happens the outcome isn’t usually good.

  23. Because the county you admitted guilt in has decided they won’t allow people who assault other people with deadly weapons the opportunity to get off probation early as a reward.

  24. I see it happen all the time, a lab test will come back and dispute the results of the cup. It’s also happens both ways.

  25. A line, no matter how faint, is a negative. Actually, this week I had to “eat crow” (yes I’m old) in front of a client who I thought was positive. When I showed them their test, they said they saw a line. A change of light and a few more minutes and low and behold I saw a faint line. I apologized and they passed their drug screen. A line no matter how faint, is still a line, and it’s a negative.

  26. Your drug test proved that there was enough THC in your body to fail, that’s why you…failed.

  27. PO’s are lied to on a daily basis and the there is no way to prove you didn’t smoke or ingest THC after testing positive on a drug screen. Also, most probation agreements also say you can’t be hanging out at bar or places of “I’ll-repute” which a club is considered one. My only suggestion would ask to have your sample sent to a lab.

  29. A probation officer can't just have someone arrested in their office unless a new charge was committed there or an active warrant is on file for the person. Missing a meeting is not something someone would be arrested for immediately. More than likely the boyfriend had an open warrant pertaining to his case and that's why he was arrested if he actually was. Only a judge can have someone arrested for a probation violation and they more than likely have to go through a revocation hearing to have that done.

  31. There is no telling, you can search his name on the county court's website for where he was arrested and find out though.

  32. I concur, he probably had an open warrant if he was in fact arrested at the office, or he threatened someone at the office or committed a new offense while there. There is a process for when someone has their probation revoked which includes a hearing in front of a judge.
